Please read these Terms of Service carefully before booking an event at The Gathering House. By submitting a booking inquiry, signing a rental agreement, or attending an event held at our venue, you agree to be bound by the terms below.

01.

The Agreement

These Terms of Service ("Terms") govern the rental and use of The Gathering House, located at 4842 Mackey Ranch Rd., Bruceville-Eddy, TX 76524 ("the Venue," "we," "us," or "our"), by any individual or organization booking an event ("Client," "you," or "your"). These Terms apply alongside any signed rental agreement or event contract, which will take precedence in the event of a conflict.

By requesting a tour, submitting a booking inquiry, paying a deposit, or otherwise engaging our services, you confirm that you have read, understood, and agree to these Terms on behalf of yourself and your guests.

02.

Booking & Deposits

A date is considered tentatively held only once inquired about, and is not confirmed until a signed rental agreement and non-refundable deposit of [deposit amount or %] have been received. Deposits are applied toward your total rental balance.

  • Dates are booked on a first-come, first-served basis.
  • A completed rental agreement must be signed by the Client prior to confirmation.
  • Deposits are non-refundable but may, at our discretion, be applied toward a rescheduled date within [timeframe] of the original event date.

03.

Payment & Final Balance

The remaining balance of the rental fee is due no later than [number] days prior to the event date. Events booked within this window require payment in full at the time of booking.

We accept [accepted payment methods]. A refundable security/damage deposit of [amount] may also be required, to be returned within [number] days after the event, less any deductions for damages, excess cleaning, or overtime fees.

Late payments may result in loss of the reserved date without refund of amounts already paid.

04.

Cancellations & Rescheduling

We understand plans change. If you need to cancel or reschedule your event, please notify us in writing as soon as possible.

  • Cancellations made more than [number] days before the event may be eligible for a partial refund of payments made, excluding the deposit.
  • Cancellations made within [number] days of the event are non-refundable.
  • Requests to reschedule are subject to venue availability and may incur a rebooking fee of [amount].
  • We reserve the right to cancel a booking due to non-payment, violation of these Terms, or circumstances beyond our control (see Force Majeure).

05.

Venue Use & Guest Conduct

The Client is responsible for the conduct of all guests, vendors, and invitees during the rental period. The Venue reserves the right to end an event early, without refund, if conduct threatens the safety of guests, staff, or the property.

  • Maximum guest capacity is [number] and may not be exceeded.
  • The rental period includes agreed-upon time for setup and breakdown; events and guests must vacate the premises by the agreed end time.
  • Smoking is permitted only in designated outdoor areas.
  • Illegal drug use, firearms, fireworks, open flames (other than approved candles), and glitter/confetti are not permitted unless otherwise agreed in writing.
  • Children must be supervised by an adult at all times.

06.

Vendors & Catering

Our vendor policy is to be confirmed. Where outside vendors are permitted, the Client is responsible for ensuring all hired vendors (catering, bar service, entertainment, rentals, etc.) carry appropriate licensing and insurance, and comply with Venue rules and load-in/load-out windows.

The Venue is not responsible for the quality, conduct, or performance of any third-party vendor hired by the Client.

07.

Alcohol Policy

Our alcohol policy is to be confirmed, including whether outside alcohol is permitted, whether a licensed/insured bartender is required, and any applicable Texas ABC licensing requirements.

Where alcohol is served, the Client is responsible for ensuring compliance with all Texas Alcoholic Beverage Commission regulations and for confirming that no alcohol is served to guests under 21.

08.

Decorations, Setup & Breakdown

Clients may decorate the space within the agreed setup window using Venue-approved methods only. The following are not permitted unless otherwise agreed in writing:

  • Nails, screws, staples, or adhesive that may damage walls, floors, or fixtures
  • Loose glitter, confetti, or rice
  • Open flame candles without a fire-safe base
  • Fog machines or hazers, unless pre-approved

All personal items, rentals, and decor must be removed by the end of the rental period. Items left behind may be discarded or subject to a removal fee.

09.

Damages & Liability

The Client is financially responsible for any damage to the Venue, its furnishings, fixtures, or grounds caused by the Client, their guests, or their vendors during the rental period. Repair or replacement costs will be deducted from the security deposit, with any excess billed separately.

The Gathering House is not responsible for injury, loss, or damage to personal property belonging to the Client, guests, or vendors, except where caused by our negligence. To the fullest extent permitted by law, the Client agrees to release, indemnify, and hold harmless The Gathering House, its owners, and staff from claims arising out of the use of the Venue.

10.

Insurance

Clients may be required to provide a certificate of event liability insurance naming The Gathering House as an additional insured, particularly for events involving alcohol service. Requirements to be confirmed at booking.

11.

Force Majeure

Neither party shall be held liable for failure to perform its obligations where such failure results from circumstances beyond reasonable control, including but not limited to severe weather, natural disaster, fire, power outage, government order, or other acts of God. In such cases, we will work with the Client in good faith to reschedule the event where possible.

12.

Photography & Media

The Gathering House may photograph events for use in marketing materials, our website, and social media, unless the Client opts out in writing prior to the event. We will make reasonable efforts to avoid identifying private guest information in any such use.

13.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or a Venue rental shall be resolved in the courts of [County] County, Texas.

14.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our policies or applicable law. The version posted on this page at the time of your booking governs your event, and any material changes to a confirmed booking will be communicated to you directly.
